IMPORTANT—PLEASE READ CAREFULLY: This Web Hosting Acceptable Use Policy (the “Hosting AUP”) protects customers, internet users, networks, providers, and Static Data Hosting (“SDH,” “we,” “us,” or “our”) from unlawful, abusive, insecure, or disruptive use.
This Hosting AUP forms part of the SDH Web Hosting Terms of Service and the SDH Master Terms of Service. It applies to every website, file, message, application, process, server, IP address, account, reseller account, and other resource using an SDH Hosting Service.
1. Responsibility for Use
You are responsible for activity conducted through your Hosting Service and for compliance by your employees, contractors, customers, resellers, end users, website visitors, applications, and anyone using credentials or systems under your control.
You must maintain reasonable controls suited to your service, promptly investigate abuse or compromise, and cooperate with reasonable SDH requests. You may not assist, encourage, conceal, or knowingly permit conduct prohibited by this Hosting AUP.
2. Lawful Use
You may use the Hosting Service only for lawful purposes and in compliance with applicable Philippine law, the laws applicable to you and your users, lawful orders, provider rules, and third-party rights.
Prohibited use includes using the Hosting Service to create, host, store, transmit, advertise, sell, facilitate, or link to content or activity that is unlawful; obtained through crime; used to commit or conceal crime; or subject to a binding takedown, blocking, preservation, or other lawful order.
3. Child Sexual Abuse and Exploitation—Zero Tolerance
Any form of online sexual abuse or exploitation of children (“OSAEC”) or child sexual abuse or exploitation material (“CSAEM”) is strictly prohibited. This includes creating, possessing, accessing, storing, linking to, advertising, distributing, transmitting, facilitating, streaming, or live-streaming OSAEC or CSAEM, as well as grooming, luring, sexualizing, exploiting, or trafficking a child.
SDH may immediately block access, remove or isolate content, preserve relevant records, suspend or terminate service, report to competent authorities, and delay notice to a suspected offender when required or permitted by law. SDH will perform the preservation, response, reporting, and cooperation duties applicable to web hosting providers and internet intermediaries under Republic Act No. 11930 and other applicable law.
4. Unauthorized Access and Cyberattacks
You must not use the Hosting Service to perform or facilitate:
- access to a computer, account, network, data, or device without right or authorization;
- credential theft, password cracking, brute-force activity, phishing, account takeover, or distribution of stolen access data;
- denial-of-service or distributed denial-of-service attacks;
- unauthorized port scanning, vulnerability scanning, interception, packet capture, or surveillance;
- data or system interference, including unauthorized alteration, deletion, encryption, corruption, or disruption; or
- circumvention of access controls, service restrictions, resource limits, or security measures.
Security testing of a system you lawfully control must remain within that authorization and must not threaten SDH infrastructure, other customers, providers, or networks. Testing likely to generate abusive traffic or alerts requires SDH’s prior written approval.
5. Malware and Compromised Systems
You must not create, install, host, transmit, or operate malware or harmful code, including ransomware, spyware, credential stealers, botnets, backdoors, remote-access trojans, destructive payloads, cryptojacking code, or command-and-control infrastructure.
Legitimate security software, research, or samples may be used only in a lawfully authorized, appropriately isolated environment expressly suitable for that purpose. Shared Hosting may not be used for live malware research.
If a service is compromised, you must act promptly to contain it, rotate credentials, remove malicious components, patch the cause, and follow reasonable remediation instructions. SDH may isolate a compromised service immediately to protect others.
6. Fraud, Deception, and Impersonation
You must not use the Hosting Service for phishing, spoofing, impersonation, fraudulent sales, investment scams, advance-fee schemes, fake support, identity theft, payment fraud, money laundering, credential collection, deceptive redirects, forged headers, or materially misleading representations.
You must not conceal the true origin of traffic or communications for an unlawful or abusive purpose. Privacy tools used lawfully are not prohibited merely because they protect identity, but they may not be used to evade this Hosting AUP.
7. Spam and Messaging Abuse
Unsolicited bulk or commercial messaging is prohibited. This applies to email, SMS, instant messaging, comments, forms, forums, social networks, and other communications sent through, hosted by, or advertised using the Hosting Service.
You must:
- send marketing messages only where you have a lawful basis and verifiable recipient permission when required;
- identify the sender accurately and avoid deceptive subjects, routing, domains, or headers;
- provide and honor a clear unsubscribe or opt-out method promptly;
- secure mailing scripts, forms, lists, and accounts against abuse;
- not use purchased, harvested, scraped, or unlawfully obtained contact lists; and
- retain reasonable records of consent and provide relevant evidence to SDH when responding to a credible complaint.
Hosting websites promoted by spam, operating an open mail relay, mail bombing, list washing for abusers, or supplying tools principally intended for spam is prohibited. SDH may rate-limit or block messages to protect deliverability and network reputation.
8. Intellectual Property
You must not use the Hosting Service to infringe or misappropriate copyright, trademark, patent, trade secret, publicity, database, or other proprietary rights. Prohibited examples include warez, counterfeit products, unauthorized software keys, pirated media, and services principally designed to evade lawful access controls.
A rights holder or authorized representative may send a complaint to legal@staticdatahosting.com containing:
- the complainant’s name, authority, physical or electronic signature, and reliable contact details;
- identification of the protected work, mark, or right;
- the specific URL, IP address, account, or material complained of;
- a clear explanation of the alleged infringement and requested action; and
- a good-faith statement that the information is accurate and the disputed use is not authorized by the rights holder, its representative, or law.
SDH may request evidence, forward the complaint to the Customer, restrict access, or require a court or competent-authority order where ownership or legality is genuinely disputed. Repeated or serious infringement may result in termination.
9. Privacy, Harassment, and Non-Consensual Content
You must not unlawfully collect, disclose, sell, publish, or misuse personal data; expose credentials or financial information; dox another person; stalk or unlawfully surveil; make credible threats; facilitate targeted harassment; or publish intimate images or recordings without required consent.
Collection or processing of personal data through your website or application must comply with applicable privacy and cybersecurity law. You are responsible for appropriate notices, lawful basis, access controls, retention, and security.
10. Violence, Terrorism, and Serious Harm
You must not use the Hosting Service to make a credible threat of violence, coordinate or incite imminent unlawful violence, facilitate terrorism or trafficking, recruit for a prohibited violent organization, provide operational assistance for serious crime, or glorify abuse in a manner prohibited by law.
Lawful news reporting, documentary, educational, historical, or counterspeech material is not prohibited merely because it discusses harmful conduct, provided it does not otherwise violate law or this Hosting AUP.
11. Adult Sexual Content
Adult sexual or pornographic content is prohibited on Shared Hosting and on any plan that does not expressly permit it. On another service, such content requires SDH’s prior written approval and full compliance with applicable age-verification, consent, recordkeeping, privacy, and content laws. Approval may be refused or withdrawn where the use creates legal, payment, provider, security, or network risk.
Content involving a minor, a person presented as a minor, non-consensual sexual content, sexual trafficking, exploitation, or unlawful obscenity is always prohibited.
12. Regulated and High-Risk Activities
You must not use the Hosting Service to offer or facilitate regulated goods or services without all licenses, permits, disclosures, age controls, and approvals required by law and provider rules. This includes controlled substances, prescription medicine, weapons, gambling, financial services, money transmission, securities, and virtual-asset services.
Fraudulent high-yield investment programs, Ponzi or pyramid schemes, prime-bank schemes, unlawful lotteries, and deceptive “guaranteed return” programs are prohibited. SDH may require documentation and prior written approval for a lawful regulated or unusually high-risk service.
13. Network and Infrastructure Abuse
You must not:
- interfere with or degrade SDH systems, provider facilities, or another user’s service;
- generate abusive traffic, excessive connection attempts, reflection or amplification traffic, or route manipulation;
- use an IP address not assigned to you or announce unauthorized network space;
- operate an open proxy, open relay, anonymizing exit node, public VPN, traffic relay, or similar public-access service unless the plan expressly permits it and SDH approves it in writing;
- cause an SDH or provider IP address, domain, or network to be blocklisted through your intentional, reckless, or repeated failure to remediate abuse; or
- attempt to bypass bandwidth, metering, billing, isolation, authentication, or platform controls.
14. Resource Abuse and Fair Use
Your use must remain within the resource quantities, technical limits, and normal purpose of the purchased plan. You must not consume CPU, memory, storage, input/output, processes, database connections, network capacity, or other shared resources in a manner that materially degrades service for others or threatens platform stability.
SDH may use operating-system, control-panel, network, database, security, and provider measurements to assess resource use. Temporary throttling, process termination, traffic filtering, or isolation may occur automatically or manually when necessary to protect the platform.
Where use is not urgent or abusive, SDH will ordinarily ask you to optimize, reduce use, or move to a suitable plan. Published plan specifications or limits shown in ClientBox apply and may differ by product.
15. Shared Hosting Restrictions
Shared Hosting is intended primarily for ordinary websites, web applications, and associated email. Unless a plan expressly permits it, Shared Hosting may not be used for:
- standalone backup, archival, cloud-drive, file-locker, or bulk-storage service;
- public file exchange, media mirror, download portal, torrent tracker, seedbox, or peer-to-peer application;
- cryptocurrency mining, proof-of-work computation, or resource-intensive blockchain processing;
- game servers, IRC daemons or bots, unattended public crawlers, or persistent custom daemons;
- public proxy, VPN, anonymizing relay, or Tor exit service;
- continuous video or audio streaming, transcoding, or high-volume media delivery; or
- cron jobs, automated processes, or database workloads that exceed the plan limits or impair other users.
A private backup or media file reasonably incidental to an active website is not prohibited merely because of its file type, but it remains subject to the plan’s storage and resource limits.
16. Dedicated, Cloud, and Virtual Server Use
Dedicated, cloud, virtual, and bare-metal services may allow workloads not suitable for Shared Hosting, but all plan limits and the rest of this Hosting AUP still apply. A dedicated allocation does not permit illegal activity, attacks, spam, abusive scanning, harmful content, or misuse of upstream networks.
Unless Server Management Services are included, you are responsible for system administration, patching, firewall rules, access controls, application security, abuse response, and backups.
17. Resellers and Downstream Users
If you resell or provide access to the Hosting Service, you must impose terms no less protective than this Hosting AUP, maintain accurate downstream customer and contact records, provide an abuse-reporting method, and act promptly on SDH notices.
You remain responsible to SDH for downstream use. SDH may contact or act against an affected sub-account directly when urgently necessary, but doing so does not make SDH a party to your customer agreement.
18. Security Maintenance
You must keep customer-controlled software supported and reasonably current, remove abandoned installations, use secure permissions, protect secrets, and promptly remediate vulnerabilities or compromises. You must not expose databases, administrative panels, backups, private keys, or credentials without appropriate access controls.
SDH may require an upgrade, patch, configuration change, password rotation, isolation, or temporary shutdown where a service creates a material risk. If you do not respond within a reasonable time, SDH may take the least disruptive measure reasonably available.
19. Abuse Reports and Cooperation
Report suspected abuse to legal@staticdatahosting.com or through a ClientBox support ticket. Include the affected domain, IP address, URL, timestamps with time zone, relevant headers or logs, description, and reliable contact details. Do not send unlawful content when a link, hash, screenshot, or description is sufficient.
Customers must respond promptly to credible abuse notices, preserve relevant information when lawfully required, stop the activity, correct the cause, and explain the remediation. A response that only deletes a visible file without addressing compromise or recurrence may be insufficient.
20. Investigation, Privacy, and Disclosure
SDH has no general duty to monitor all Customer Content. However, SDH may review relevant traffic data, logs, configurations, files, or communications when reasonably necessary to operate and secure the service, provide support, investigate a credible violation, protect affected persons, or comply with law.
Any access, preservation, use, or disclosure will be limited to a lawful and reasonably necessary purpose and handled under applicable privacy and security requirements. SDH may disclose relevant information to providers, complainants, security researchers, payment services, or competent authorities where authorized or required by law. Notice may be delayed or omitted when prohibited by law or necessary to avoid compromising an investigation.
21. Enforcement
Depending on severity, urgency, history, and risk, SDH may:
- issue a warning or remediation request;
- rate-limit, filter, block, or disable a port, process, message, file, URL, account, or IP address;
- quarantine or isolate a compromised service;
- suspend part or all of a Hosting Service;
- remove or disable access to prohibited content;
- require an upgrade, security change, or written remediation plan;
- terminate a material or repeated violation; or
- preserve evidence and report or refer the matter to a provider or competent authority.
SDH may act immediately and without advance notice where delay could expose a child or other person to harm, spread malware, enable fraud, damage a network, violate law, or create material liability. Where lawful and reasonably practicable, SDH will explain the action and required remediation.
Fees, refunds, and data availability following enforcement are governed by the Hosting Terms and mandatory law. SDH will not impose an undisclosed fixed spam or abuse penalty, but you remain responsible for authorized remediation work or direct third-party costs that you approve or that the agreement expressly allocates to you.
22. Review of an Enforcement Action
You may request review through a verified ClientBox ticket. Identify the affected service, disputed action, supporting facts, and corrective measures. SDH will review the request in good faith, but urgent protections may remain in place during review.
A review request does not require SDH to restore clearly unlawful content, disregard a competent-authority order, expose another person’s confidential information, or violate provider rules.
23. Changes to This Hosting AUP
SDH may update this Hosting AUP to address new abuse methods, security risks, provider requirements, or law. The current version will show its effective date and version number.
Changes do not retroactively convert conduct that complied with the applicable earlier version into a past breach. For an existing recurring Hosting Service, a material policy change ordinarily applies at the next renewal after reasonable notice, unless earlier application is required by law, competent authority, urgent security need, or mandatory provider rule.

25. Relationship to Other Terms
This Hosting AUP supplements the SDH Web Hosting Terms of Service and Master Terms. If the documents conflict on acceptable use or abuse enforcement, this Hosting AUP controls for that issue, subject to mandatory law and provider requirements.
Terms governing payment, refunds, cancellation, warranties, liability, disputes, and data removal are stated in the Web Hosting Terms of Service. This Version 2.0 replaces the earlier Hosting AUP for future orders and for existing Hosting Services when it becomes applicable under Section 23.
